Eviction Expungement (S. 744)

  • Status: Active
  • Position: Support
  • Bill Number: S. 744
  • Session: 126th General Assembly (2025-2026)
  • Latest Update: January 13, 2026
We support S. 744

This bill would allow a person to apply to have a civil eviction expunged. The judge must grant the expungement if the person has had no additional evictions for at least five years since the last eviction.

We support this bill because: An eviction should not follow you around for life. Currently in South Carolina, a single eviction filing on a person’s record can make it extremely difficult to apply to rent housing. Some corporate landlords automatically discard tenant applications from people if they have a single eviction filing on their record.

In a state with a housing shortage and sky-high rent, people should not have to overcome additional barriers when it comes to housing. If a person has had no evictions for five years, it is only fair for that person’s previous eviction to be expunged.
