South Carolina has been issuing marriage licenses to same sex couples since November 2014, but the Social Security Administration has failed to issue instructions authorizing its clerks to accept these licenses from South Carolina. In late January 2015, after our appeals to attorneys for the Social Security Administration and the Department of Justice, the SSA released an internal guideline authorizing its offices to accept same-sex marriage licenses issued in South Carolina as proof of a valid marriage.
